Thanks for your post.I have one more query.I have recently joined a company where we have hired some vendors for PF and ESIC policies.My ESIC vendor is asking to provide me the ESIC number of my employees previous company.He is saying that ESIC has a provision that 1 person can not be alloted with ESIC number twice so employee will have to continue their old esic registration number is new company.but it seems irrelevant.I think this term is applicable in PF process if employee is willing to continue his PF number.Kindly clear my doubts.

Both of that is wrong
You need to allot a new ESIC number for each employee that joins.
It does not matter if he has or does not have an existing ESIC number.
If he is to continue with the old number, how do you plan to pay ? You will be paying into the previous company and asking them to credit it to the employees ESIC account ?
I think you definitely need a different consultant to deal with ESIC
About PF, you have to issue a new PF number here too.
The employee will be required to transfer the balance in his own account to the new one

Thank you so much for your reply. Yeah about PF I meant to say that he can link previous amount to his new PF account to.My HR colleague in Mohali is dealing with those vendors who is saying so..I told him that its not correct but He is relying on them as he is saying k it is mentioned on ESIC site.

I would like to give answer to your query as under:
Your ESI vendor is absolutely right in asking you to provide the ESI number of the employees in their previous employment. He is very correct in saying that one person can not be allotted with ESI number twice or more. This is a basic you being HR must know. This is not a new rule or new law.
When you register any new employee with you on ESI portal as IP, you need to click on whether the employees is already registered as IP or not. IF he is already registered as IP in previous employment you need to give his registration number i.e. ESI number and re-register him under same number.
Prior to IT Roll Out also, there was no need to submit fresh declaration form of IP to ESI Corporation in case the employee was already registered with ESIC as IP. Only his ESI number was submitted to the Corporation.
Your comments on PF also are wrong. There is no willingness by employee whether to continue the PF or not. It seems HR professionals of today's ERA need to have basics of Social Security Enactments and Practical Knowledge.

I too look forward this forum for sharing of knowledge and clearing doubts related to HR issues. This forum is an open forum wherein anyone can express his / her views, whether they are right or wrong. I personally gained lot of things from this forum.
But off late I started feeling that in this forum, the intellectual discussions / queries / responses are very negligible. Most of the discussions are misguiding. Our posts are viewed across the world and we represent the HR Fraternity. This is my concern.
Normally, I avoid crossing any senior member but this time I could not controlled myself. I repeat, at least those HR professionals (not all) who are participating in this forum need to abreast themselves on the basics of labour laws.

Just to make sure i understand what you said :
When an employee joins a new company, he is expected to continue his existing ESIC number, though it has a different prefix.
He is not going to get a new ESIC number as was happening earlier.
So now the company will have an ESIC code, but the ESIC number of the employees need not be having the same prefix ?
