I am working with a company with almost 6 years. I am seven months pregnant and I am being harassed by my Managers.
My appraisal was due in the month of October. My first reminder to my immediate Manager was on 15th Jan'14. I have been informed that appraisal discussion would be carried by Senior Manager HR and thrice it was scheduled but he never did the discussion stating sometimes he was busy or sometimes he didn't turned up on time.He works in Evening shifts i.e 7-4 and always I have been asked to stay during his shift time to take the discussion further. My shifts are 9am to 6 pm.I always stayed to take the discussion further on the scheduled date and time but it never happened. In the month of feb I have been advised by doctor to be on complete rest due to certain complications of which my Manager was aware and was not able to stretch.
I again started following up with them in the month of March through mail mentioning all the facts that wont be able to stay for long hours due to the complications and requested to take the discussion during my shift timings. But to my shock and surprise after continuous followup I got the reply that appraisal would not be done due to shortcome in performance and was asked "that if could complete my shift then y cant I stay back for an hour". I did clearly mention that due to commuting by public transport and travelling alone wont be possible for me.
Few points:
My Manager is passing such comments since she came to know that I am pregnant that "I am liability" "I am expensive resource"
My Manager neither had a discussion about my performance throught the year nor had a formal appraisal discussion
When asked about my appraisal she simply said that senior Manager will sit with you and you don't have any choice
She telling to other members of team that I wont come back after maternity leaves.
I am in the recruitment team if my performance was short then how could my manager get appraisal, since she also have team target.
It seems they don't want me to continue and harassing me.
Kindly advice what action I could take to stop this..

Dear Ahuja,
I do undestand your situation, 1st of all, by law, they can't ask you to keep waiting after your shift is over on medical ground.
2nd i belive that, as your in to the recruitment, so, you must have maintain the certain MIS, tracker, which is self explainary & self performance indicator. eg- how many position you handle, out of how many you have close, within what TAT time, how much company cost you have save..(closer of possions by job portal, consultancy, internal reference, etc), try to get the benefits from those exercise.
it will give you the clear pict. on the same & it will help you as documented evidance for when you can ask for justification about your performance..
I hope you understand, what i am trying to say. just remember onething, accuracy of performance appraisal is depend on what tools or theory use by managment & managment also not keen for higher increament as higher cost occure in their budget.
