Dear all im working as HR in a banking sector recently we had a theft in our office a new joiner had taken money from office and ran,but now they are holding my salary and giving complaint against HR department.But that candidate was shortlisted by department Manager and branch head.Kindly Give guidance how to tackle it.

This is very unique case in my view.
Your management is holding your salary just because you are in HR-Recruitment..!!
You should immediately submit your written request that the candidate was like other candidates and short listed by so and so person as per his abilities. No one was aware that he will commit theft, and there is no mean of complaint against the HR Department. So, holding your salary on any ones this type of act. So, kindly release your payment at the earliest. If they don't release your payment then you can clear them that, you don't want to do so, but if your payment will not be release, you will go to Labour Office for this.
As this is a theft case, So the bank should complaint against that person to Police and should track that person with the help of documents submitted by him.

After evulating all the pros and case of the case, I'm sure you will be in a good position to take decision, or even in my point of view your organization should make a tight policy for recruitment rather than to stop your salary.

I dont think the company can hold your salary, for the theft of the money.
The person in-charge of the locker/drawer should be held responsible, as its his/her responsibility to keep the same locked.
Lodge a police complaint and send a person in his residence (i hope u must have the address).
Dont worry.. you would get your salary.

I am of different opinion, as a HR have you done his/her BGV and secondly before giving the task of cashiering in the bank have you done his police verification which is a must for almost all banking sector for the Cashier post, last but not the least don't you have the policy or security check at the beginning and end of the day done to your staff. Does your bank react casually towards their staff. If you file a police case they will ask the same question which I asked.
Learn from the above episode and do some correction in the policy and take corrective steps before giving any task to the new joiner as a HR instead of cribbing with the situation.

This is a very strange case, and I am really surprise to know that your salary is kept on hold for a theft case by a new joiner, and it is more surprising to know that you have not scheduled an HR interview for that particular candidate because if an HR has interacted with that candidate then there were the possibilities that particular candidate may not have been hired as many of times an experienced HR guess the future threats by a particular candidate at the time of HR interview itself, anyways even if you have interviewed that candidate, that does not guarantee you may get to know about his behavioral traits by a face to face interaction of few minutes, so no where you are responsible for the same, so I will advise to you first ask the officials for the exact reason of putting your salary on hold in writing secondly give them your explanation in writing, apart from it please tackle this situation in utmost care and be polite on your part with the organization as it may adversely effect your employment.

Imagine If HR has appointed a driver for his Higher Manager and the driver uses the car which meets with an accident. In that accident someone on the road is killed. The driver runs away. Now read this carefully
This manager gives a complaint on the HR that he is responsible for the accident and for the death.

I suggest That the HR should make decision to back ground check before employment.
