Dear All
I need some information.
We are a construction company and we are doing a extension construction work inside a Factory Premises.
Which will be applicable for us. Factors Act or BOCW
In case factories Act is applicable do we have to maintain records, health centres etc., or the client is responsible for all of these things

Dear Mr. Vamsi,
The Factories Act is applicable to the organisation where you are constructing. As a principle employer it will be the responsibility of the occupier of that company.
For you BOCW will be applicable.
For construction Industry where Factories Act is not applicable BOCW will be applicable.

Dear Member,
I could understand from the posting, basically your company is a construction based company. Presently, your company doing expansion and construction activity in Client Site governed under the Factories Act.
Since, your company is not engaged in manufacturing activity it comes under the BOCW Act.
The Client Site is already governed under the Factories Act, hence there is no additonal application of BOCW Act. If it is a green field project the BOCW Act will apply.

From you answer what I can understand is that as we are working in an existing Factory, Factories act is applicable for us.
Do we have to fullfill all the requirements as per Factories act or is it the Client who has to provide all the facilities

Dear Member,
The Construction Company (May be your Client) should follow the BOCW Act and they will not be covered under the Factories Act.
In a place where really the manufacturing process is carried on that industry naturally comes under the Factoires Act, Any additional construction or expansion the BOWC act doesn't apply. (Exemption is provided under the BOWC Act)
However, both the Companies have comply with the rules of Contract Labour Regulations and Abolition Act, depends upon the number of employees employeed in the place where the construction activity is carried on.

Dear Sir
Thank you very much for the reply, we are actually doing an expansion project, so by your reply I understand that BOCW (we will be exempted) is not applicable and we have to follow "Contract Labour Regulations and Abolition Act" apart other legal requirements
