i met an accident during going to office in jan 2010 and i am covered under esic. at that time esic give me about 3 months salary as benefit but refused to give Permanent disablement benefit (PDB) as Commuting Accidents were not covered but now i heard that As per the amended provisions of the Act w.e.f.1/6/2010 of ESIC these Commuting Accidents are covered.
so my question is am i eligible for Permanent disablement benefit (PDB) as i met an amputation below knee and have permanent disablity of 70% ?
if not can i file a case against ESIC in court?
pls help me as soon as possible

The amendment to the Act has no retrospective effect and therefore, it is difficult for you to get the status of Permanently Disabled. Madhu.T.K

i have a query regarding Permanent disablement benefit.
in my unit one workmen met with an accident in 2011.and he lost one finger in the accident,he has paid wages for 3 months from Esic,but he has not got PD benefit till.
In my position there was another person who has not shown focuss on this issue and even not recorded in the accident register ,now the workmen is asking me regarding this benefit ,now what should i do in this issue,is there still any chances for applying again for PD benefit.
If it is wat is the Procedure for that.
Iam Specialist in EPF PRovisions But Dnt hv that much Experience in ESIC procedures.
Please helpme out in this matter.
