Presently I am working in a Manufacturing unit, as Admin Manager in Hyderabad. The factory and office are situated in same
premises in Hyderabad.
The company is producing tower parts, structures to various customers in India like Aircel / Barti Airtel / BSNL / VODAPHONE,
TATA, TOTALCOM, etc.. and also to some major customer like GTL, NUTEK. Apart from the telecom line the company also
fabricating and producing transmission line and supplying to KPTCL / Siemen / ABB in India.
We supply fabricated tower parts to the places required by our customers and erect the same which includes civil works also.
The company has appointed Contractors and sub-contractors for fabrication of steel structures (tower parts) in our factory
and those contractors are producing the material under the supervision of the our company Production Manager and Quality
Supervisors.
In this case who is the principle employer? who is the contractor? Who is sub contractor?
Are we the principle employer to our contractor? Should we register our organization as Principle employer?
Should the contractor working under us is a direct contractor or sub contractor?
Should Form V to be given to Sub-contractor also?
What is the relation between
1. Our customers and us ?
2. Us and our contractors?
Also Please clarify the following : (as per Contract Labour Act and Inter State Migrant Workmen Act?
1. Who is the Registering Authority?
2. Who is the Licencing Authority?
In whose favour the DD for for the following to be taken under both Act?
1. Registration Fee :
2. Licence Fee:
3. Security Deposit:
4. Duplicate copy of Registration Certificate?
In which bank the DD to be taken?
IF Principle employer is in one place (say Chennai) and contract work is at another place (say Bangalore) then where to apply
for licence (in chennai or Bangalore)
If principle employer is at one place (say Chennai) and contract work (constructing Tower parts incl civil work) at various
places in the same state (say Tamilnadu) then
1. should the contract apply for licence for each site?
2. Should he apply for those licence in chennai or in respective places.?
I have gone through both CLRA act and ISMW Act and understood about the forms. But not able to understand the above details.

Iam afraid the contarctors and sub-contractors who are carrying on the work of fabrication of steel structures on the premises of your factory will also be treated as part of your factory and if so, the applicability of Contract Labour Act is debatable and hence the other queries may be superfluous.
