Under which of the Act & Rules you are to calculate earned leaves ? If your unit is covered under Factories Act, 1948 then you can count maternity leaves for any number of days not exceeding twelve weeks for eligibilty purposes but the woman employee will not get el for these days. Thus we are not to calculate el on these maternity leaves.

Dear sir,
As you already mentioned that a person is in maternity leave, as maternity leave is provided to anyone during pregnancy by duly certify by the medical officer, and it is for a certain period and employer has to pay full salary to the employee during maternity leave.Secondly if she is already enjoying the leave benefit of one how she can be eligible for el/pl otherwise if there is completion of maternity leaave and she want to extend the same she must approach to her doctor for extension of the same and benefits which remain be the same.

Dear Ruchi Anand,you have to refer to Shops & Commercial establishments Act/Factories Act as applicable to your Company to know whether Period of Maternity Leave is eligible for Leave provided under the applicable laws i.e Shops & Commercial establishments Act/Factories Act
