My name is Sanjay. I was working for a company as a Sr. Manager - Delivery SAP. I was on probation period. I joined the company December 01, 2009 and resigned 22nd March 2010, due to severe back ache problem without giving notce period. I resigned through email as i was not able to move out of the bed. But before resigning, i handed over the entire document or data stuff & companys property to their HR & Director as per their decision.
After resigning i did several follow up for my salary, but till today i didnot receive my salary, but on the top the HR and the Director was threatening. Please let me know what is the solution. they are even not giving me the relieving letter when they came to know that i got a job in a well reputed MNC. MNC is not ready to take me on board because i do not have the Relieving Letter of the previous company. I am in a bad shape. Please suggest me.

Let me put something open across to you. In your statement you said that you resigned due because of severe back ache/problem. Why didn't you apply for a medical leave/work at home etc rather than putting down your papers?
Again at that point of time do you know how long will that medication period would be? You have to be clear on to such queries for the members to post/give a proper comment.

I agree with Mahesh.
First you should have availed Medical leave, otherwise you must have produced your doctor's/ hospitals's medical certificate and could have taken LWPs and have taken rest and i am sure then everything have been smooth.
Second I do not see any point in resigning. Company do support such cases.
In my company a guy had a bad accident, we waited and never asked him to resign and now he has rejoined us after 5 months.
Next if your condition is such bad, I dont understand how did you managed to attend the interview, got selected and got another job.
If you are looking for job even in such condition then why did you leave your previous job?
It sounds harsh but in such situations what your HR is doing is right.
I am in HR, and no company would take this. Imagine you are running your company and somebody resigns coz hes unfit but try to join elsewhere what would you do? Will you happily relieve that guy ? Surely NO.
So before blaming others for their bad behaviour first check if this is a reaction of something bad from your side, what would you have done if you have been there in their situation.
Dont take me wrong but this is the right procedure.

I agree with Mahesh bcz instead of resigning you can apply for the Medical leave but you resigned and just bcz of that it seems your employer got something fishy in it and not giving you exit clearance or maybe your resigned was not accepted by your immd supervisor.
So if you are feeling great now, go to your employer and inquire about your resignation whether it is accepted by your supervisor or not.
And about reliving letter, they cant provide the same to you until your exit clearance or this issue will not clear.
You just need to visit your boss/supervisor and told him your problem personally and request him to give you a clear answer..Im sure you'll get the solutions.
And also you can bring your medical bill and certificate and submit the same to the HR and this will help you...Best of Luck

So if you are feeling great now, go to your employer and inquire about your resignation whether it is accepted by your supervisor or not.
And about reliving letter, they cant provide the same to you until your exit clearance or this issue will not clear.

Thanks for the reply. There was a lot of mis-management in the company from TOP to BOTTOM. There was no Management Hierarchy and there was lot of issue with the company internally. There was nothing like a HR department. I got a SLIP DISC problem in the month of March 2010, secondly subordinates working under me were delivering their roles and responsibilities as per the wish of HR who were not at all having any knowledge of the projects implementation or the projects. The company was not a professional company. There was a lot of mess internally in the company. The company was not an IT company but a placement agency. I got trapped by their big talks and got into the job without enquiring about the company.
I resigned on 22nd March 2010 on the medical ground and this was known by the company. As the Delivery Manager, i already handed over all the project information status to the Director. Thirdly all the subordinates was working directly under the Director and reporting to Director. As i told there was a lack of Management hierarchy and reporting, this was also one of the reason of quitting. I was at home till July 2010 and i got a new job offer in the month of july 2010. I was already on rest from March 2010 till 4 months. Since 4 months i was asking for the resignation clearance.
There are incident where 15 other Ex-Employees were not paid their dues who was working in head hunting department. There are lot of Police case filed against this company for their mis-behaviour with their Ex-Employees. I was also harrassed mentally by the top management for delivering the project that was bought at pea-nuts without any technical consultant & functional consultant consent. The project which was supppose to be the cost of 15lacs were bought at 2 lacs. Marketing people & the Directors were getting the projects at such a pea-nuts and if asked why they are doing so, i used to get the answer, that it is not my job to get involved in the commercial. There was a lot of pressure on the delivery side of the project without giving proper resources. This is one of the few examples. There are many lot incident of unprofessionalism. So when i got a problem of Slip-Disc, i stated very clearly to the company that i could not work in such a scenario and i would like to take rest as per the doctors advice for a month or more as well as i also wanted to quit the company in good faith. I dont think i am wrong. Still i would like to have advice on this.

If you are in Probation in the time of resigning the Job the notice period is only for 7 days. In addition to that if you submitted the resignation along with medical certificate you have not liable to pay notice period.
Email resignation is only an information of quit. Hard copy of the mail duly signed by you is compulsory for the processing of full and final payment. As a professional/ Manager you should complete physical handing over formalities along with departmental clearance along with HR.
This is suggestion that after completing the above said formalities, pls send a Letter to management through registered AD as request for you Dues, After 15 days send legal notice through an Advocate. Latter submit a B-suit to you nearest civil court claiming dues amounts along with interest. Definitely success with you.

Do not fear, Straight go to HR or director, apolige, for mistak done by you, only they will, cry for indiscipline done by you, but they will adjust, only they may delay the process by some days, that is also a remote possibility. All are human being on earth, slightly some are more postive some less. But do not create an biased illusion in your mind.

You have resigned during your probation period therefore a company is not entitled to give you your salary or your dues. Much as anyone would dislike to hear it, its a lose for the organization to hire a person and rehire for the same position withing 3 months.
Data handed over the entire document or data stuff & company's property to their HR & Director does not give you any advantage. They hired you and paid you during your probation (your learning period where ROI is very low for an org)
Companies want to avoid such practices and losses and hence therefore have to safeguard themselves. Please treat this as a learning and move on.
