We are allowed 30 days of annual leave in our compnay. I have resigned and my last day with my company is on 30th June and uptil now I have consumed 15 days of my leave for this year. Am I eligible to consume my remaining 15 days if yes can you suggest any reference to law as My HR suggested that you are going to work for 6 months of this year so I am eligible for 15 days of leave only.

i think your HR is suggesting right. Almost in every company leaves are earned every month by the employees. you had a chunk of 15 days leave till June which you have already availed. you are not eligible for further leaves.

Holidays are totally different from the leaves but if an employee takes a certain number of levaes and any holiday/week off is coming in between his leaves, then those will be counted as leaves and can be adjusted against the CL or PL balance of that employee.

If you are serving your notice period (If any), then you are not eligible for any leaves. Its standard practice that leaves are credited, on monthly pro-rata basis. If you are leaving your job on June 30, then your remaining leaves will not get credited.

You are not eligible for any leaves during your notice period . Its compulsory that the candidate need to work for the total working days ( during notice period ) without any absence.
So you can't expect the 15 days leave.

As per our Company's Leave policy, PL for executives will be credited for the previous year i.e. leave for 2009 will be credited on 1.1.2010 (31 days) which can be availed during 2010. In case, if any resignation, the balance PL days can be encashed since the leave credited is earned during 2009.
If any executive joined mid of 2009, PL will be credited on pro-rate basis on 1.1.2010.
Also, he is eligible for PL for those working days during 2010. e.g. if an executive worked upto 30th june 2010, he will be eligible for 15 days PL. i.e. 31/12*6.
CL & SL are credited as advance leave for the year 2010.
