We are having an Office at Sakinaka, We are into I.T. firm and rendering Sales & Services and Reparing of Laptops, Desktops, Printer and scanner of the customer and giving services to the customers.
We had covered and taken Shops & Establishment Act License. A few days before Factories Inspector visited into our office and he noticed us that your office should covered under Factories Act and you should have Factories Act License.
He had given us 2 days time. Please help and guide us that whether we are in FActories Act and we sholud have to take a compulsory Factories Act License. Already we are having Shops & Extablishment Act License.

since you have not engaged in manufacturing process, no need to get registered under factories act.
Factories act of 1948 clearly says that in any premises when 10 employees along with power (electric), or 20 employees without power (electric) engaged in manufacturing process they have to get registered under factories act.
If you do not come under this crisis, you can just give a letter to him saying we have not engaged in manufacturing process. hence we have taken only shop & establishment license .

"Reparing" is process covered under definition of "Manufacturing Process" in Factories Act. Hence Registration under Factories Act required.
However test has to conducted whether the said procees is predomient in nature, if not then your existing registration under Shops & Establishment Act holds good

Repairing and servicing constitute manufacturing porocess as defined under Sec 2(k) of the Factories Act and the Inspector of Factories is right in asking you to get your self registered under the Factories Act. However, before enrolling your unit under the Factories Act, you have to see which activity is primary and which activity is subsidiary. If reparing is primary and mandatory after sale service, then you have to register your unit under the Factories Act. On the other side the reparing is subsidiary and it is only optional after sales, then Registration under Shops Act is sufficient.

Even though Repairing and servicing are considered as manufacturing process under factories act, there is a criteria that 20 employees should be working without the aid of power (10HP). If the no. of employees is less than 20, no need to register under factories act.

Since our Company is Research and Development in Pharma sector. We are not in manufacturing tablets or any form of pharma products. But yes, we are using hazardous chemical for testing purpose. So my question is whether our company has to follow or obtain Factory Licence or Shops and establishment licence ?
