Dear Friends
I have one question, X Company has 100 employee's factory licence, in company at works 80 employees working. Company have many different marketing offices in all over india, their 30 employees working and company paid P.F. 130 employees my question is that company has requrired to change factory licence or not pl.relply and get sugestion.

Dear friend,
I feel that the number of workmen working in the factory shall count for strength of that factory. I feel that the marketing staff, working away from factory shall not be considered for factroy licence purpose.
Kindly correct me, if my opinion is wrong.

If yr strength is 130 on account of marketing employees, and u hv marketing offices, the office are covered under S & E Act and the marketing employees as well. For the purpose of Factory Licence, the strength will be 80 only.

Dear Mr. Harish,
Factory License is totally based on strength and Power Load at Factory Premises only. Means any Company may have more than one factory license but that would compliance under EPF & ESI on a singly code. So, no need to modification in license in your case.

Plz. refer Factories Act, 1948 & Concerned State Factories Rules. There you will find Definition of 'Factory'. Then you need not to ask for the advice.
Head Office / Marketting / Sales offices are different. That comes under Shop & Establishment Act. Factory licences is given for the Particular no. of employees & Power load in HP.
As your licence is for 100 employees & 80 workers are working in your factory, no need to change / amend the licence.
You can develop rapport with govt. officials & directly ask them such querries. They will help you being public servants. Try, they will help you really.
