Dear Experts,
One MNC SW IT company engaged us a direct contract employees from Mar 2005with a renewal of six months.
In Aug 2007 they suddenly asked us
to sign with a manpower company with same salary due to internal audit objection. So we are working under with new manpower company and deputed to same working place of job with previous company and same salary. Till now salary increase for us. If we asked that manpower company and they says that you are flexi staff by hirers and salary increase to be given the company which we are working. Also they says that we are under their roll only and eligible for increase in salary. What we have to do to get our salary increase which is pending from Aug 2007.
Any one help us to get our salary increase as usual to compare other employees.

Hi Kaygee,
As per your posting presently you are a contract employee ie., you are in contract rolls. First point is that are you getting minimum wage as per the minimum wages act, as you are telling that since Aug., 2007 you didn't get any wage hike, normally every 6 months the govt. is revising the wages of contract employees, pl check the same.
The second point is that even though you are working under contract employment you are not getting the wages on par with the employees working on company rolls who are doing the similar job, this a major issue, if both are doing the same work and not getting the similar salary is against laid down rules.
Check out the above two points critically and submit a request to the concerned labour department.

Given below the details of my employment for your reference.
Company: MNC SW IT Company in Chennai and they are
developing GDC in Siruseri Sipcot Complex around
200 crores.
Job Profile: Working as Librarian - Single Handed
Joined as Company Direct Contract - March 2005
to July 2007
Then Company insisted to sign contract with another staff payroll company and asked us to same Job.
From Aug 2007 to Till today our CTC as below.
No Increment and Bonus etc.
Basic - 2300
HRA - 920
Conveyance - 500
Medical Allowance - 400
Professional Dev Reimbursement - 500
Deputation Allowance - 931
Bonus / Ex-gratia - 460
Gross Salary - 6011
Less deductions
PF/ESI/Prof Tax/Ins etc - 412
Nett Take Home = 5599
We do not know the minimum wages for this type of work.
Please help me in this regard.

dear
this type of appontment comes under unfair labour practices.they are making fool of people by doing so but this will not stand in court of law.by seeing your salary beakup
,company has shown basic less than the minimum wages to state.so they are violating PF act also.

Sir,
Thanks for your valuable advice. Since we don't know about the Monthly Minimum Wages for these type of Jobs. This month on 16th June my working company HR asked me to sign for further three months of extended contract from 01.06.2009 to 31.08.09 as per the same terms & Conditions of August 2007 offer letter given by contract payroll company. We have signed the letter after three days under protest. HR told at present no increase is possible. Hence asked us to decide by ourself. What we have do. For our sake livelyhood to running family at current situation we are forced to do signature with same terms. Who will take all this to Government Department Levels to save our future.

Dear all,
Can you pls help me on this.. a person has to give me a amount of 70,000 and he given me a cheque for 7months for monthly basis 10,000. i deposited the first month cheque and got returned and second month also got returned, because of an insufficient fund. what should i do for this on legal formalities. can you guide me plsssss.

Dear Pushparaj,
Go to the local police station with a copy of your bankpass book and cheque return slip and register a complain u/s 138 of Negotiable Instrument Act. Return of cheque due to insufficient fund is a criminal offence and penalty may extent upto 2 years imprisonment or fine or both.

Dear,
Direct go at advocate and tell all about your cheque bounce details and reason of cheque transaction.
Afterward advocate will send notice to him for compromise, if fornt party can't come for compromise and automatically case stand under Neogatiable Instrument Act 1948.
Don't worry for same u vl get proper judge. oky :)
