Dear Alok ji, Under EPF & MP Act 1952, the Principal Employer is responsible for compliance of all the employees employed directly or through contrctor, as such it is advisable to have all over control over contractor employees as far as PF is concerned, even if sub contractors are having their own code nos.
Pl. take all steps to watch that PF is deposited every month before 15th so as to avoid damages and interst on late deposits.It is advsable to with-hold equivalent amount till u are not satisfied that PF in r/o all ee,s have been deposited.

As per CLRS act it is mandatory you have to maintain all the satutory records. as per the subcontractors provision it is the responsibility of principle employer responsibility to maintain all the records.

We are contractor and we have already got a contract license for 1000 people & we have 16 sub-contractor.
Can i maintain all register as a contractor on behalf of Sub contractor ? bcz contractor responcibilties is maintain all the register like fine,deduction,workmen employed by contractor,advance..........

You have to maintain all the nil register and form XIII, Form XVI, XVII & XXIII for all the sub-contractors, and you have to deduct the PF for them and remit the same.
If Labour Inspector comes your site, he will ask the license holder and not the sub-contractor. If you produce the same then there will not be any problem and the matter gets closed there itself. But if you failed to do so, then only the question goes to the principal employer. Here principal employer will ensure on your cost. mind it on your cost.
So better take the help from your sub-contractor and maintain the same to safeguard yourself.
