We discuss on this matter in light of posting one member of the community. Who seek advice whether his working with some other establishment in leave period is legal or illegal.
We are dragging the matter to other side of the lane. The I D Act also refrain from gainful employment during the mattter of termination challenged by petition during the pendency of case.Whereas to discuss on angle of query whether double employment is legal or ilegal. No one ever raised any question over the working of daily wage/peice rated earners or person engaged in household service or other kind of work though fall under double employment. The very nature of the working is like that but things changed when a house servant kept by someone on monthly remuneration, where as the nature of job remained same. An establishment is involved in drawing,design, engineering and product development work, kindly suggest should the staff involved in job allowed for double employment for his monetary benefit.
The word moral torpitude has come as commonly used term in legal not for targetting anyone or any manner. As the term house of profit considers for disqualification and gainful employment is also of similiar nature. The big problem with us that we consider "birds in bush is better than bird in hand''
