Hey Guys,

I need your assistance regarding dual employment, one of my friend working as an HR in an IT company he got an opportunity to work as freelancer in recruitment. I would like to know is it legal to work ?

as per my opinion he can work as a consultant/freelancer if present employer accepts, but he should declare total income to Income Tax Department . It means he should file IT Returns with consolidated of his total Income .If his total Income is below Rs. 1,60,000/- means after all deductions/allowance as per IT no need to pay Tax . If his income still more he has to pay tax as per IT Slab Rates.

In my view it is not illegal and i dont think its come under tax hmm no need to pay tax but am not sure. Let see our seniors opinion.

Dear Karthik,
It completely depends on to the regulation which the first company or the company in which he/she works full time. Normally company won't allow their employees to engage in any other free lancing or part time works. Still it depends on to the management of the company.

Karthik, If it does not affect his normal duty, he can proceed. There are many higher officials are doing dula employment without others knowledge. What can we do?
