One of our employee serving notice period for past 30 plus days, as per our company policy he suppose to serve 45 days and no leave during his/her notice period. Though he has taken informed unpaid leave(for 2 days) claiming that met with accident, and conformed he will return back on so and so date, he continued saying the same for 3 to 4 times within a week, but till now he dint report back. His transition work is still pending. In couple of days his termination ends due to his attitude and irregularity at work.
Kindly suggest me on this.. what needs to be done?
Should i mail him to return back to work for these last 2 days? If yes, please share me the mail draft..
Deduct his salary?
Should i hold his experience letter or Relieving letter till his transition gets done properly?
or should i ask him to extend notice period?
Note : We terminated him for taking 1 month Paid leave With permission of Work from home, but there were no productivity at his end, this complaint raised by our client. He updated fake reports and to prove himself that he worked from home.
Kindly suggest me for smooth closure..

It appears he is taking the organisation for granted, and that is not acceptable. The notice period is not an empty formality and cannot be wished away. It is the obligation of the employee to complete the assignments in hand and hand over the charge smoothly. If there is a failure on the part of the employee in this, he is to be clearly told that his relieving depends on the completion of the formalities satisfactorily and because of his acts and omissions he needs to work for additional days before he can be relieved and issued relieving certificate and paid full & final dues. You need not pay him for the period he is said to have worked at home. You may post draft letter/e-mail to this effect which could be considered by the seniors.
