We have a project in Pune & we are a secondary stake holder of the Project & we represent a sub-contractor for the Project & we need to deploy the manpower for the work to be performed as per the requirement of Primary stake holder.
So please clarify, do we need Registration under Bombay Shop & Establishment Act.
My registered office is in Delhi & do not have any office in Pune.

It was a very good piece of information.
I have a querry here since they will get NOC from Gram Panchayat, aren't they still covered under Shop and establishment or Factories act,
i.e. for eg, if I have NOC from the gram Panchayat to run a Warehouse. According to the Definition of Shop i will be covered under Shop and Establishment Act. Now since we get NOC from the Gram Panchayat I will not register my self under Shop and establishment yet all the provision like management of Register, working hours of my establishment will be govern under Shop and Establishment act right? if not under what rule or any Act are they covered.
Please provide your valuable information to this.

Hi Vishy,
you have said that if the location comes under Grampanchayat then no need to take Shop act. We also have one unit where we have got NOC from Grampanchayat but not registered under Shop act. So Grampanchayat noc can work in this case and it is equivalent to shop and establishment act certificate?

in this thread i have study that registration under S & E act. or factory act. is mandatory to get registration in EPF & ESI however as per my knowledge we can also produce the service tax or sales tax registration to get registration in EPF & ESI hence No need to obtain licence under S & E act & factory act.
pls correct me if i am wrong?

In continuation with Smita's response, 2 possible queries come into my mind, which are as follows:
1) If we obtain Gram Panchayat NOC from respective authority would i need to follow S&E checklist or there would be different checklist available under Gram Panchayat.
2) And if it all I don't obtain NOC Gram Panchayat what are all consequences and challenges under the state constitutions. As such many of you are aware that the respective authorities wouldn't issue NOC certificates even after continues follow-ups.
I would be glad to get Legal guidance under above circumstances...
Also please share some sort of an experience which you come across in past..
