dear sanju as eligible employees are less than10/20 so you are not required to take ESi code.legally you are not bound to take any other policy also.as a welfare measure you can take volunterily.

Frist let me know when ur org or estb started and that time whether the area was coverd is more imp. bcoz as u mentioned 200 employees and i dont thing it is one day process so as per ur balance sheet & incorpration certificate if ur covered, then u have to apply and even pay back wages as per the Act. and futher u also told that if 7 employees r under coverageble limit, so it means it is applicable as mentioned by Mr Malik.
so jst apply with all doc required and get provisional code to avoid further prlb..

But in one of the case, we have in Raigad district, we were asked by the ESI officer that we will have to include the staff under 6000 (that time) for ESI since we have staff more than the stipulated count. The argument was that all such employees must have cover under ESI as per Act, even if we have covered them under seperate group policy. We were actually paying for both and since the count was less we never bothered.

there may be a chance in future that an employee with a salary less than 10000 may join.... so the ESIC registration is mandatory ....

Yes !! organization must be covered according to employees' strength. However in ESI return contribution shall be 0. As the ESI limit is crossed.

As far as your organisation is concerened it should be covered under E.S.I. (Act become applicable if an establishment employing 10/20 employees as the case may be). But coverage of an employee based on his/her salary that is up to Rs. 10000.00. Since in your orgnisation salary more than Rs. 10000.00 therefore employees will not cover under E.S.I.
On the basis of given facts in your query, E.s.I. is applicable on your organisation though employees are not covered. You required to send nil return as prescribed under Act.

Where in companies, if anyone is not drawing gross wages Rs.10,000/- month, though the company falls under coverage of ESIC act, employees will automatically out of the coverage of the Act and Scheme.

you should write a letter to local esi office about your issue that we have 200 employee in our org. but their salary is more than Rs. 10000/- . so please advice us what is the coverage rule under ESIC Act 1948 in this situation.
