Dear All
i have recently joined a IT company , here we have 36 employees, in feb 2012 we have 20 employees all r getting more than 16000 salary, but due to some projects we hire 16 more employee in march 2012 , all are junior level employee getting less than 15000 salary.
our company was established in 2008, but as all emp are exempted from ESi we have not applied for ESi number.
now we want to register in ESI coverage.
what is the procedure? do we have to pay any penalty for late registration ? if yes how much penalty will be charged?

First you have to check whether your company area comes under ESI notified area for coverage or not. If yes,
You can approach your nearby ESI local office Manager. He can guide for registration. You can also go for on line registration. On request ESIC Local Office Manager / Enforcement Officers can visit your company and audit the base records and vouchers, ledges, etc.,
If they found any wages/salary less than 15,000/- you have to pay both the contributions. No interest.

The act is applicable to the factories employing 10 or more workers.
Under section 1, Sub Section 5 under the esic act 1948 the Scheme has been extended to shops, hotels, restaurants, cinemas including preview theatre, road motor transport undertakings and newspaper establishment employing 20 or more persons.
