I resigned on 29 Sep and left the company the next day without a notice period. The notice period is of 30 days. On 5 Dec I received an email from the shared service center that full and final settlement will be released. In that leaving date is written as 28 Oct instead of 29 Sep also. They will send an amount for 28 days for October by deducting basic pay in notice pay recovery. I don't want that money as I have not worked for the company for that period. What should I do?

Dear Colleague,

Kindly check again. In the given situation, they are relieving you only after the completion of notice period, despite you work or not. Probably they will not pay for these days and show absent etc. Hence check and get clarified with the HR

From the payslip downloaded they are deducting 30 days notice pay recovery (basic amount ) from the 28 days salary which they will send ( though I have not served notice).

I do not think you are going to get any money.
They will deduct your notice pay, in fact you have not worked, so they will mark you as absent. Then they will deduct your notice period salary, so they will ask you for paying back the balance.

Or if you are lucky, they will adjust against leave salary, bonus and other accumulations.

In either case, if they are doing a full and final, you will get your relieving letter, which is a good thing. In most cases you would not get any relieving letter and BVG in future would be affected. Just take what you get and be grateful.

Termination clause is:-
Either party can terminate the training hereunder by giving one month’s notice in writing to the other and upon expiration of such period of one month, the training hereunder shall terminate. The Company may at its sole discretion terminate the Contract of Employment without notice and / or salary in lieu of notice, if in the opinion of the Company, the continuance of your employment is detrimental to the interest of the Company. Provided that, in the event of termination as provided hereinabove, all benefits / perquisites / allowances shall stand forfeited immediately, and you will only receive any statutory benefits as applicable to you on the date of your termination.
