I have received a notice from ESIC it's regarding an accident claim the facts are -

1. An employee came into service on 04.10.2018 and because of the issue on ESIC site got registered on 11.10.2018.

2. The employee met with an accident on 10.10.2018.

3. Now they are saying we have done fraud by registering the employee after the date of accident (but we have a letter sent to them that their site is not working before the date of accident )

4. And by that time there was no rule that the employee should be registered within 10 days and if we take that rule as well then also we have registered the employee within the time period.

5. The most important thing the employee who met with the accident didn't receive any benefit by ESIC.

They have imposed Section 84, 85 & 53 and rules 11 & 12.

Please anybody can help with any ruling by any High Court or Supreme Court regarding this matter.
