Dear team,
I have joined this company 3 months back and have found a car (Elentra) accident issue claim pending the car had been transferred from one of our sister concerns THe MD of both the companies being the same the name of the company got changed but the insurance company was not informed for the same.
Now the insurance company is not providing the car accident claim telling that the actual owner of the car is not the insurance holder of the car.
It is a legal issue and if our legal advisor sends them notice and prove them wron only then we will get the insurance claim.
My boss is killing me for the insurance and after a no. of chase also the insurance company is not giving us a single rupee.
Plz. suggest a way to get this problem solved.

I would recommend that you get the Accounting Department to provide records of premium payment statements/demands from the insurance company, and the cancelled, returned checks from the past years issued by the old company and the new company (which I assume were used for payment by the Company).
In this way it can be shown that the insurance company knew, or should have known, that the premium for the car insurance was properly paid; that the car was properly insured under one or both companies, that they cashed the premium checks and therefore assumed liability under the policy.
The car was properly insured; it is of little relevance who the "Owner" is/ was. In fact, the "owner" may be the company.

I would advise you to approch to your company's legal officer coz the insurance company are bound to compensiate only to the owner of the vehicle which in your case is the sister concern of your co. and legaly speakng until you prove your ownership to the insurace co. dey are not going to sort out the issue.
