I work in a Pvt. firm named Ansr in Bangalore. I have completed 11 months in the company. We got a mail from HR which states the following about maternity leave benefits :
The latest laws in which maternity leave period has been changed to 26 weeks is only applicable for team members who are covered under ESIC. The eligibility criteria for coverage under the ESIC scheme is based on gross salary. Any team member whose gross monthly salary is less than 21000 or below will be eligible under the ESIC scheme.
Can somebody tell me if there is any such clause in the bill? I am 3 months pregnant and need to know this before I can talk to my HR about maternity leaves.

Do you notification from HR is wrong.
The revised maternity benefit act applies to all people who are not covered by ES I C. The company is liable to pay full maternity benefit gross pay level for a period of 26 weeks, which not more than one month can be before delivery. This means, that post delivery at least five months of paid leave will be applicable to you
Incidentally, ES I C has made similar provisions for those covered under.
There is a clarification on this matter posted on the website of the central government, which you can be seen in find my Google. Take that with you when you speak to HRD
