While the Factories Act read with the rules provide of constituting the workers representatives in the Safety Committee through election of the workers. Such procedure though is time and money consuming are likely to disturb the Industrial Relations harmony due to intra Union dynamics effecting the production an d productivity. Thus is there a legally acceptable way out like seeking proportion nomination of the workers from the Unions and approach the Factory Inspector to allow constitution of the Safety Committee as required as per the Factories Act read with the rules framed there under. Tenable opinion with legal citations if any is solicited from the Community please.
