If I ask the Hr he told that in my appointment order itself they had mentioned that both company and worker contribution of PF is deducted from the worker salary.

Hi Praveen
It's 100% wrong. Need to check with your HR Manager and get it cleared.
Every where the general practise is 12% Employee and 12% Employer.
how other employees in the organisation agreed ... really surprised.

Dear Praveen :
Please check if they have included company contribution as a part of your CTC amount.
As you mention, company contribution is mention in your appointment letter and employee PF contribution, Professional tax etc are deducted from employees monthly salary.

Pls note that you cannot specify anything in the appointment letter or in an agreement which is in violation of the law and it will not stand the legal scrutiny. Recovery of PF employer share form employee’s salary is against the sprit of the law. The company is liable to refund the amount recovered.

Hi Praveen,
It is correct. PF contribution will 12% from both Employee and employer. PF ceiling amount is Rs.6500/- it means Rs.780pm.
If an employee monthly PF cross Rs.780/- they may contribute only Rs.780/-, if that employee want to contribute more than Rs.780/- he may approach the concerned HR and can ask for 12% deduction only.
So praveen just check out from your HR that you cross the ceiling amount or not.
PF formula is (Basic+DA)*12%
If you cross more than Rs.780/- then it is correct or else you have to talk to the management.

It is wrong practice of your employee. He cannot deduct employers shere from your salary. If it is done it is wrong.

If employer has issued a ctc break up to the employee then it is obviously that the part of the employee would be deducted from his CTC, which is general practices now days. most of the companies offer CTC break to the employee in which all the liabilities of the employer is laid down on the employee. I request to all the seniors that please tell me that is there any provision in he law which can prove that the CTC is iligal
