Dear Seniors,
Our sister concern organization which is a small scale job-work unit has received a show cause notice from BOAT Mumbai asking them why they have not complied for apprenticeship act under which they were to engage 2 graduate apprentice and 3 vocational ones.
Their issue as per the last communication from BOAT couple of years back this organization went ahead taking interviews of candidates, and shortlisted few but most of them reverted saying they have got better offer or some reason or the other and few didn\'t revert at all.
The board has sent this notice which calls upon this job-work unit to show cause as to why no legal action should be taken against them under section 30.1(c) of the apprenticeship act.
This organization has evidences of interviews and assessment sheet but most of post interview coordination and feedback happened over the phone with candidates so there is no evidence of those.
Kindly guide what should be done. This matter is of utmost urgency

Under Apprentice Act the employer has to make quartery return to the Director / Apprentice Advisor about the progress of the Apprentice Candidates in your organization if they did't join your organization then it should have been communicated to the Apprentice Advisor.
Now you can given them reply that you are ready to take the Apprentice Candidates of the Board suggest any number to your organization.

While agreeing with Prashant ji, my advise to you is, to meet the officer personally and accept your mistake. Assure him for no such repetition in future. Take guidence from him. Ask him to provide candidates if he has. He will be happy to provide you the candidates. Everything will be all right, hopefully.

Can you please elaborate on various returns under Apprenticeship Act? Long years back I handled this portfolio. I only remember the forms APP-1, APP-2, APP-3, APP-4 etc. But I feel the return on progress of candidates for apprenticeship is a half yearly return. I may be wrong. It's my request, please make an attempt to give a sort of write up.

Please meet the concerned officer at BOAT and explain the situation and then give in writing the factual position giving dates of interview, names of candidates selected and dates on which they communicated inability to join with reason. Specifically request condonation of technical oversight and willingness to hire apprentices currently.
This should resolve this since BOAT proceeds legally only in cases where wilful inaction against their directive has been committed.
