Dear All,
Hi I am Suman working as a HR in a Pvt Company.
I have a query, suppose any employee leaves the Organization without prior notice and after a month comes to submit his PF Form.
Can the Management accepts and duly processes it or rejects to sign claiming that he has not been relieved properly.
Will the Management have rights to stop an individual PF Form without signing claiming he is not eligible to processes.
Regards,
Suman

The mgmt cannot hold back the PF form legally, as he has got other options as well.
However, u may discuss with the concerned empoyee to settle the outstanding, if any, separately, without linking it with PF settlement.

Hi Suman
There is no any provision to stop claiming PF of individual. It is better to submit individuals PF withdrawal forms. Even in the least case if management is not willing to sign on the withdrawal forms there are other options to claim PF Funds

I agree with Mr.Dixon & Mr.Jeevarathnam
I would like to share section 72 of Provident Fund Scheme which is as follows-If the applicant is unable to send the claim application through the employer or duly attested by him, for any reason whatsoever, he may forward it to the Commissioner or any other officer authorized by him in this behalf, and wherever necessary, the Commissioner or any other officer authorized by him in this behalf, may forward such application to the employer and the employer shall be required to return it within five days of its receipt.
Going by the above section, even if employers doesn't process the form employee can take advantage of section 72.
Regards,
Suresh
