Dear Ajay,

As per the Factories Act, no women should be employed in a factory between 7pm to 6am. But with special permission from the Inspector of factories and Boilers, one can employee up to 10pm. But under any circumstances, the act does not permit employment of women between 10 pm and 6 am. This is not applicable to establishments coming under Shops and establishment Act.

But, now a days, many factories are engaging women round the clock. Infact the Madrass High Court has made a judgement with repsect to the textile industries in Tamil Nadu permitting employment of women in nght with some conditions. Likewise, the Punjab Govt. also has made similar provision in the employement of women in textile industries.

Usually, the Inspectorate of Factories voluntarily do not initiate any action. If there is any complaint, they will give notice.

Care should be taken to see that unhappy occurrance like sexual harassment does not occur during night hours. If happens the sitauation will go out of control.

Factores Act whcih was made about 60 years back did not forsee the cultural development that would happen in India by this time.

hence, it is high time the Act is amended to permit women to work round the clock.
