Dear Trishna
Earn leave,privilage leave or Annual leave ,all are same.it means there is no difference .
In factories act it is called Annual leave which is mentined in section 78 and 79 of factories act.
In few shop and establisment act it called as privilage leave ,whereas in some shop and est act it is called earned leave.

The difference is that under Factories Act such leaves are called Earned Leave (EL) and under Shops & Estb. Act the same are called Privilege Leave (PL).
Although the nature and purpose of both PL and EL are same, however, applicability differs in terms of minimum allotment, which is, under Factories Act, 1 EL for every 20 days of work (18 per year)and on the other hand under S&E Act 5 PL for every 4 months work (15 per year).

Thank you for the prompt reply....just a further clarification, we are an NBFC, as per our leave policy its 18 EL + 6 CL + 6 SL. Are we on the right track?

What I perceive reg Earned leave and Privilege leave is, Earned leave is one which one earns on the basis of working days as per Factories Act. Every Management has a prerogative to have its own leave policy for it's employees. Management may prefer to provide leaves strictly as provided in the Factories i.e. One earned leave for every 20 days of working, this leave is what we call as earned leave i.e. 15 days in a year. Similarly 7 CLs will be permitted under the Act. But most managements restrict this calculation to a group of employees (Workmen) and may prefer to provide different set of leave rules to Office Staff and Officers and may provide Privilege leave (EL), Casual Leave and Sick Leave in excess of what is given to the other group/provided in the Factories Act. Ofcourse Sick Leave will be provided to those who are not convered under ESI. Privilege leave provided by the Management could be 30 days in a year (CLs 10 days in a year normally), some managements provide the same twice in a year i.e. from 1st January and 1st July every year. This leave can be carried forward to a certain limit at the discretion of the management, Privelege leave accumulated beyond that limit gets lapsed and encashment of this leave is also permitted by the Management in many companies. Sick leave also will be allowed to be accumulated to certain limit beyond which the unavailed SL will get lapsed. CL has to be availed during the year and unavailed CL at the end of the year gets automatically lapsed. Every management can at their discretion formulate their own leave policy and implement the same. Statute only provides the minimum eligibility, but never limits the same.

HI,
I work in a IT firm where we have 27 total leaves out of that 1.25 PL and 1 CL per month.Here I just saw 18+6+6 but our company gives only the number leaves I mentioned is this okay or need any changes in the leaves.Is it okay to have less leaves?

Agreed with Mr. Jago Rao opinion. NBFC falls under the Shop & Establishment Act where EL should be 15 and CL, SL should be 12 . However, Mgmt. may frame their own policy in line with the same.

We want to know the payment of esic damages. We have already remitted principal amount, interest amount. Actually, we have remitted payment of principal & interest for non-functioning period of our manufacturing process. Now, The Esic department has sent notice D-19, regarding to pay the damages immediately. We request you to inform us the following.
1. Whether we can avail amnesty scheme?
2. Whether we can pay 50% or reasonable amount of damage?
3. Whether we can approach to ESIC Headoffice, New Delhi, to get some relief.
Kindly suggest us.
