laws keep changing here and sometines we are unaware of the latest changes..
anyways let me start with this query..
1) If a company does not give an employee NOC, and if he gets a ban from labor of 6 months, is there any other way he can lift the ban ? I'm talking baout an employee who has finished 1 year of service only...
Thanks in advance...

Yes Mr Sandeep,
6 months ban can be lifted by paying AED5000/ as he has completed one year of service.
This payment can be made by the employee himself or the new employer.
It is applicable for all category.
If an employer imposed ban more than actual six months, it is very difficult to lift. Then the employee move to labour and act on the situation

Hi all,
I am hari , working as a BDM in bangalore. I was working in dubai , due to ma father's health condition I was forced to come back to india. I did not cancel ma employment visa in dubai. Now i have planned to go for higher studies , I wanted to know that whether will it be an issues since I have not cancelled the visa. Will it affect my career if I am planning to go to some other countries?? When I asked my company , they told me that if i am not returning back in 6 months the visa will get automatically cancelled.

hi mildred,
if a person is terminated during probabtion he/she will have to reimburse all the costs to the company any expenses incurred in getting him/her on board.
there could be a chance in him getting a ban if the sponsor does not give him an NOC.
He has to amicably request them to give him an NOC or pay them any compensation. In this was an NOC could be given....

What if a person completes his 3 yr contract.... will he still have the 6 months automatic labour ban???
I had a problem with one candidate on the visa issue... he had completed 2.9 months in his previous company (after his visa was stamped) but it has crossed 3yrs from his DOJ coz he worked on visit. N now we can’t get an employment visa coz the system shows he has 6 months ban... We are not allowed to lift it also...
The visa issue here is making recruitment even tough added to the scarce man power supply in this region...
