Employer forgot to file NCP days (employee was on leave during that period after that he died)

Can anyone please suggest employer forgot to file the NCP days of an employee and that employee was on leave during that period after that he died, can the employer apply for NCP days to EPFO?, so that Employee can get EDLI Benefit.
