Hi, after my MBA joined a company in the covid period, it was WFH. worked for 4.5 months but the culture was not good, Training was not given properly and expectations were like work for 13-14 hrs, the laptop also was using personal. So i quit when got new offer. Didn't want to serve notice period but was ready to pay Notice Pay as mentioned jn contract but they were not talking clearly nor HR was supportive and were not ready to give relieving letter to trouble me, so stopped working 5 days after putting resignation & new company said to wait for 2 months post the date of giving resignation to join us.

Now 2 months are going to end and they have credited 12k( each month)even i have not worked for full 2 months, so told them to reverse it and now the company is telling ok for reversing + let's do exit formality and you pay accordingly for notice pay, so apart from 12k is there a need to give Notice pay amount as the new company does not require relieving ???( i have told them everything). Also, can the old company create any Date of exit or other EPF related problems??


I just don't want to pay them as they wasted 2 months for it for which i was ready at the start itself.
I would be thankful for your advice in this difficult situation of mine.

Dear Colleague,
In short you had served the required notice period of 2 months time. But you say you had not worked but salary was credited. Now practically there is no question of notice pay in this case as the employer has not yet relieved you but you completed the 2 months time. If your conscience is not allowing nothing wrong you can ask them to reverse the salary paid. Over and above there is no question of Notice Pay to company by you.

You may ask for relieving letter and experience letter from the company with positive approach and get it done considering your future employments and if you want to ignore this short service then take call boldly and take up the next offer. But clearly inform the next employer that you may or may not come with relieving letter and explain them transparently the facts.

As far as PF is concerned normally the previous employer will mention date of exit correctly. If not done, you can also long-in and mention your exit in the portal and ask your next employer to mention date of entry suitably and through the next employer you may transfer the accumulations through on line portal.
