Does this mean all charitable trust hospitals must come under EPF and the doctors working under them also are eligible for EPF from 2015 in all states in India? Also i want to ask under which ministry does charitable trust hospitals come and do they come Under RIGHT TO INFORMATION ACT?

Yes, this means that the hospitals are covered under the EPF Act 1952 and the eligible employees are to be members of the Scheme from 01.04.2015. All public authorities are covered under the RTI Act 2005 and whether the charitable hospital comes under the Act is a question of fact and law, to be decided on case to case basis. It needs to be ascertained whether the hospital concerned is in receipt of any government concession, by way of equity, land, taxes etc. If so, there is ample chance for it to be accountable as per RTI Act. The coverage will not be there in case it is purely and totally a private enterprise.

You can seek the information on EPF compliance by the hospital in question from the local office of EPFO and further the reasons for non-compliance if it is so. Income Tax department will not be in a position to confirm the position readily. Better still, check up with any of their employee if PF is getting deducted, they have UAN etc

EPFO Office says charitable trust does not come under them and hospital says they dont deduct any pf of any employee and when we ask why they dont answer properly.they dont provide UAN and i cant find the hospital on EPF website.they are paying the employee doctor 30k basic salary per month, and still giving no response about pf details on document from them.so thats why i am asking for help from RTI if its possible.thank you for your reply sir.

@ Depends on the activity of specific hospital, better you seek information from hospital, they must have obtained exemption form the trust
In the light of the notification of EPFO of 7th September 2015, it is not understood how EPFO states charitable hospitals are exempt. In the light of it, you may prefer an RTI application to EPFO headquarters seeking information on whether the exemption to charitable trusts have been restored & for a copy of the decision not to apply the PF provisions to this particular trust. Most probably this will stir them into some activity.

@glidor sir, the hospital is a charitable trust and provides all type of medical treatment including x ray surgery and deliveries.all at a price lower than private hospital rates and chargable admission rate for different type of rooms for stay.how can this type of hospital is exempt .the real problem is they dont give any answers to any questions related to their trust.
