Dear All, There seems to be a trend in the digital marketing agencies, where employees receive their salary, resign that day and not serve notice period.
What can a company do to safeguard against this. Legal action is a long drawn and largely futile option.
Pls share expert advice or tried and tested HR solution

The HR department has to evolve an active strategy for employee retention. The place of work has to become a place the employee feels happy and to be a part of. Right from ergonomics, office ambience, to career advancement options, variable pay and incentives etc need to be thought of. Any new employee has to have a mentor who are sufficiently motivated and role models. They need to have daily interaction with the new recruitee and make them feel to be a part of the larger group.
As regards legal action to recover notice pay is concerned, insert an arbitration clause in the appointment order and make use of the provisions in the Arbitration & Conciliation Act 1996. The Arbitration award is an enforceable decree in the court and you can avoid the lengthy process and hopefully you can recover good money within a year.
