Dear members, I have a query regarding Contract Employment in Corporate India. I have 15 years experience in Training Creation and Change Management and was in long term full time employment for 11 years in an MNC. I have recently started appearing for Contract based roles; which are termed as Consultant/Contract Employee. These are either directly with some companies like IT /Finance MNCs or through other companies who provide contract Consultants to these bigger companies.
While the laws and benefits for Full Time Employment are very clear and known to most of us and companies abide as per the law, the picture is not very clear for Contract based employment especially when it comes via smaller recruitment agencies/staffing co. providing consultants to other co.
I have googled and did not find any reliable source of information for Contract Employment in Corporates regarding what are the rules regarding Leaves, Salary, Medical Benefits and Insurance.
I have received Contract Offers which are poorly written and do not mention clearly what an employee is going to get?
The hiring agencies also do not answer these questions clearly and there is a lot of grey area in terms of transparency of Benefits and Entitlements to Contract Employee especially when contracts are for a year.
Please help me with the following questions wrt to Indian Laws related with Contract Employment:
-Do contract employees get Salary Slip? (In my current contract i was shocked to know that there is no proof from the org for salary except Offer -Letter and Bank Statement)
-How many days of leaves are credited for contract employee/consultant role
-Is Professional Tax deducted? (In one of the Offer for Contract; I have TDS and Prof Tax both)
-Is Med Insurance/ Life/Accidental Insurance provided?
-PF in case of Long term contract?
- What are the benefits and entitlements provided by the employer as per the law to contract employees in corporates?
