Hello, I am working in a manufacturing Co. and my query is, we provide the company's benefits to new employees after one year this our policy. I just want to ask that if a previous employee rejoins after 3 months of resigning then in that case, can we do the apply do the same with rejoining labor and employee. or he can eligible for the benefits.

No. Even if he is an ex-employee, the person left and again rejoined; hence it is a new employment .
Extend all applicable benefits to him at par with a new employee.
Consider, after putting a few months service, he again resigns. Will you consider paying him
all the benefits right from the day one of his first employment?
