Hello, We are currently having only 5 employees on roll, and among them, one employee is covered under ESIC and we are deducting his ESIC, I want to know if we have to pay PF or we are not liable for that as there should be minimum 20 employees require for pf liability ?? That employee gross is Rs. 12,000/- pm
please help

For PF 20 nos. of employees needs to be there. However, the company can voluntarily contribute for PF. For ESIC also, 10 nos. of employees needs to there.

No need , But there is clause, if the employee had EPF UAN No. in previous company we will cover
I request experts opinion, in this issue, the org. not eligible for coverage of EPF Act due to 5 employees are working only, if they recruit one new employee and he have UAN No.
Whether is not eligible for EPF due to Org. not having code no. and not eligible for obtain code No. or he can cover under EPF Act ?

Happy morning,
Once you are covered under ESI or EPF as the case may be, irrespective of the fall in the number of employees, your organization continues to be governed under the Act.

Thanks for your revert. Please consider that employee is having UAN number from his previous company.
