Hi, Can company terminate HR bench employees in current covid 19 situation. In a case where an 12.5 years tenure employee was on HR bench as his program got rampdown and was given verbal notice till 15 April however there is no official written comunication on this. Now company is asking him to submit his resignation... Please advice....
Can he claim some sort of compensation apart from his FNF considering his 12 years of service so that it will help him to survive till he get new job in current situation of Carona virus. Thanks and Regards.

Obviously he can ask for notice pay as per contract of employment. If notice period is three months, he should be paid three months salary for early relieving or allowed to work for three months. Since it is a case of 'resignation' and not retrenchment he cannot demand any retrenchment compensation as is paid to workmen category employees. Of course, he will get gratuity as per law.

Thanks for your immidiate response. But in this case company is asking him to submitt a resignation and in returm assuring him normal FNF as per process.

Yes, when an employee is submitting his resignation by himself, he will be putting that "I may be relieved on a date which comes after three months/ or one month", as the case may be and if so, asking the employee to go immediately means, he should get three months pay.
