The maximum wage limit for calculation of compensation under the EC Act,1923 stands revised from Rs.8000-00 to Rs.15000-00 w.e.f 03-01-2020 vide the Ministry of Labor and Employment Notification S.O.71(4) dated 03-01-2020.

In such a case compensation under the ECA,1923 has to be calculated on the basis of Rs.12000/= or the statutory minimum wages whichever is higher.

Amount of Compensation:
A. Where death results from the injury : An amount equal to (Fifty per cent) of the monthly wages of the deceased (employee) multiplied by the relevant factor (Copy of factors for working attached)
OR
an amount of (One lakh and twenty thousand rupees), whichever is higher
B. Where permanent total disablement results from the injury : An amount equal to (Sixty per cent) of the monthly wages of the injured (employee) multiplied by the relevant factor
OR
an amount of (One lakh and forty thousand rupees), whichever is higher.
suppose the age of deceased is 40 yrs. and salary 14,000/- 50% wages is Rs.7,000 x 184.17 is factor than the compensation will be Rs.12,89,190/-.
