An Employee complete service of 18 years in 2014 & then he got disable & submits his ESIC Medical in company. After 2 year of ESIC Medical he submit his resignation in company. Now can you help me how much gratuity he is entitled. for 18 years or (18years+2 year ESIC Medical) 20 Year

There is no connection of ESIC with gratuity at all. Gratuity is based on 'continuous service' rendered in an organisation covered under the Payment of Gratuity Act. Pl.let me know the status of your Co./where you were working.
Is't a private sector or semi/govt.sector.
Is't a factory or a firm, regd. under the shops & commercial estt.act.
State whether the Payment of Gratuity Act is applicable to your Co.

I am working in private limited company.
I have read which i am attaching that Interruption on account of sicness, accident, leave, lay off, strike, lockout, cessation of work not due to any fault of employee will not be considered as break in service. (Section 4)

Is this resignation accepted & you are separated? what's it's status. Did you resign knowing well/having certified as to your permanent disability? And how your Co treated your absence on temporary(?) partial disability. Have you got relieved ?
