Hi All, I want to understand the legal working hours for an employee in a service based Industry in Gurgaon (Analytics Company).
Nothing sort of like work hours in defined in the offer letters just mentioning about 45 hours in a week. Also if we are made to work, 13 or 14 hours a day (We were told it happens once in a month or a year, but on ground reality it happens almost daily), we aren't payed a single penny for Overtime working hours but the company is ready to deduct the money in case of shortfall from 45.
So I want to understand if something sort of working hours are defined in the Labor Law and if I can approach the HR regarding the same.

Hi Thanks for the Information. That really helped. I work in Gurgaon, is the Act applicable to the same too or I will have to go through the Act issued by Haryana Government.

The state act in which the unit located will be applicable. So if it’s Gurgaon, then Haryana act would apply.

In Your case Punjab Shops & Commercial Establishments Act, 1958 as applicable to the state of Haryana will be applicable. R N KHOLA

SIR,
RECENTLY WE HAVE DOWNLOADED A CIRCULAR SHOWING THAT
ESI DEDUCTION HAS BEEN REDUCED FROM 4.75 TO 4% (EMPLOYER SHARE) AND
1.75 TO 1% FROM( EMPLOYEE SHARE)
BUT DATE HAS NOT BEEN MENTINED WHEN IT WILL BE IMPLEMENTED.
PLEASE HELP AS NEXT SALARY Of (FEBRUARY) IS DUE TO CALCULATE.
