Dear all, I got a new job so I have puten my resignation in my current company and they have asked to survive the notice period of 30 days and mentioned the last date of working. But now they are threatening me by saying you need to perform then only we will be relieving you or else will extend notice period. Can this be done. As on contract only 1 month was mentioned and they accepted the same. Please help me with the situation as I have to join my new company asap.

If an employer insists on serving the entire notice period before the effective date of resignation as per the terms of the contract of employment, it implies that the employee should discharge his duties as diligently as he was doing before putting down his papers. He should not develop the tendency to be haphazard in the discharge of his normal duties just because he is going to exit.
It is also equally important on the part of the employer to be objective in his assessment of the performance of the outgoing employee and he has no right to extend the notice period on the ground of alleged sub standard performance.
Anyway, the poster has to be sincere in his duties and tactful in his interpersonal transactions during the notice period so as to make his exit smooth and peaceful.

But don't know why suddenly when few days left they have given me some targeted no. And expect to do before I leave. If not then they will extend or else will consider me absconding. Please let me know if it's possible for them on legal terms to do that. What should I do.
