RWAs now a days get registered under 'Apartment Owners Act' under various state and generally employs Security Guard, Plumber, Electricians through contractors. Many sites quoted that since RWAs doesn't carry any 'Commercial Activity' it cannot fall under the category 'Employer' or 'Principal Employer'.
On other hand there are thousand of such employees deployed in these housing societies, apartment associations who are deprived of any benefit under PF, ESIC.
Whats the position of law to protect the right of such contractual employees as far as PF, ESIC is concerned? Also what are the responsibilities on RWAs to ensure that the Contractor is complying with PF/ESIC for the manpower deployed at their premises?
