The question of whether IT/ITES based units are 'Industry" or not still being debated in India. There is no conclusion arrived at. There is widespread opinion in favour of recognizing these units as 'Industry' growing. Therefore till such time proper amendments are issued the IT/ITES units are to be registered & governed under the Shops & Commercial Estts. act of the respective states only. Therefore in Maharashtra, the Bombay Shops & Comml.Estt. Act will be applicable including labour relaed regulations. Read the bare act attached.

The Bombay Shops and Establishment Act, 1948 has been repealed and New Maharashtra Shops and Establishments
(Regulation of Employment and Conditions of Service) Act, 2017 has come in to effect from 7th Sep 2017.
