I am working as a HRM in a (P) Ltd. Co and I would like to know whether one like me should follow rules for giving leaves (CL, SL, PL) as per the company act according to India or SCE act according to the state. Also I've read somewhere online that, one should be given a privilege leave only if he/she had worked for at least 242 days. Is this regarding that much of working days that he had came for work? We have a total number of 10 employees excluding 2 directors (mentioned as it is a (p) Ltd. Co)

Companies Act is a special and basic law which governs the creation, continuation, winding up of companies and also the relationships between the share holders, the company, the public and the Government. I don't think it deals with any employment matters other than the appointment of directors and company secretary. Therefore, better go through the State Shops and Establishments Act and clear your doubts regarding leave provisions applicable to the persons employed in your company. If the company runs any factory, you refer to the Factories Act,1948.
