Please guide me One of our employee went out of state for the company work for 10 days, during that days he had meet an accident, when he return he is on leave i just want to know Is This leave we calculated paid leaves or not? Please guide me.

Paid Leave; I think company should bear all the expenses incurred for treatment as the accident happened while being on duty.

If the employee is covered under ESI Act, then ESIC bears the leave salary and treatment, otherwise as per EC Act , the employer has to bear the half monthly compensation till the employee recovers and joins back on duty. For any loss in earning capacity the employer will have to pay lump sum compensation, if any, as per the Act. More details in this regard would be needed to give opinion in this regard.

Pls comply with the senior members advise and also find out cause of accident and nature of sustained injury. Ask the employee to produce all medical reports, whether he was hospitalised when met with an accident or given any first aid. If the injury is of a serious nature, how he returned back to his residence?
After getting satisfactory and genuine reports/reply with supporting documents, check whether he really requires rest for 10 days? if convince, consider his case sympathetically.

As per the act, employee can get benefit from ESIC or company has to bear as per EC. Please check how the accident happened ! If any employee in takes alcohol then no amounts will be paid.
