Hello,
I was terminated by a small company in Hyderabad.
This was done without and written warning , or notice. I was on six months probation, I fell sick and took 3 days sick leave, informed the hr about my leaves for all the three days.
On the third day of my leave, they terminated me for being irregular, sick leaves are definite LOPs in this organisation. My co-worker was absent for 11 days on probation and he's not terminated. I feel it's very unfair.
Now they refuse to pay me my dues upfront and after a fight, the said they'd pay in 45 days time from date of termination.
Should they be paying me one month's notice amount too with my FNF for working days?
In the offer letter.. It is said that they can dismiss me without notice only if I broke any of their policies.. Taking sick leave or irregularity is not mentioned in the company policies on the offer letter.
Please help.

Definitely it is high handedness of the organisation and it cannot be justified. It appears, perhaps they wanted to get rid of you that is why the selective termination in your case. But you can tell them that unless they pay your dues by the next salary date you will file complaint under the Payment of Wages Act 1936 and the consequences will not be pleasant for them.
