Dear All, Need your help on below mention situation. Employee join early in maternity leave (Before Completing 180 Days), is she applicable to take balance days Leave as per her convenience.

Dear Satish,
Maternity leave is given as a rest period after pregnancy for women and it is not a leave which can be utilised any time. First of all employer is not supposed to allow any women to rejoin after maternity period before completion of maternity leave. Also, employee is not allowed to take it later on.

Dear Friend,
You need to understand the act and benifetes sanctioned there under. The act says one can have maximum leave of 26 weeks. There is no issue if employee joins early availing maternity leave. On joining of the employee take an application and medical documents, that she availed the leave and joined as per her own wish. The leave under this act is sanctioned at strech not in phased manner. Once employee resumes the duty means, she is not entitiled for balance days Leave.
