This is regarding clarification on how to claim EDLI benefits in case on death. My father was working in a small security firm since 2014, in June-2016 he had been detected with cancer. My whole family went to a shock after hearing this and reached oncologist to have advice over it. After the suggestion of oncologist my father started taking chemotherapy and he was unable to join his duty during his chemotherapy form July-2016 to Feb-17.
Unfortunately due to his illness, we lost him on 15th-April-17, he was an Ex-serviceman and was only 53 yrs old. I have fill all the required forms for his EPF withdrawal like Form-20, Form-10D and Form-5 IF. When I wanted to submit these forms, I came to know that the security agency which was there earlier in which he worked has changed and a new security agency has come. I have taken some contact details of the previous company and informed them with all has happened with him. According to them my father is not eligible for EPS and EDLI as he was not in service from last 10 months. I again explained them that my father was unable to come during that time when he was going under treatment, but they only reply that they will discuss this their seniors and come back, still I have not received anything from them.
I request you all to guide me to help my poor family with this insurance amount and EPS. I have all his medical reports by which I can prove that he was on chemotherapy since July-16. Please help me and my family. Thanks in advance for your support.

as mention by you " security agency which was there earlier in which he worked has changed and a new security agency has come" it doesn't make any difference.Edli scheme is get entitled on the very first day of joining the establishment.and it is generally claim through Form-5 IF.
it is calculated on the basic,means the 30 times on the basic to the nominee use to be paid.
suppose member having 5000/- basic , nominee we get (30*5000)150000/- as an EDLI amount against this insurance scheme.
beside you have stated they have told you that "According to them that your father is not eligible for EPS and EDLI as he was not in service from last 10 months." kindly ask them for the EPF detail or else you can also take from member portal of www.epfindia.com. because i smell something foul when they say you father is not eligible for EPS and EDLI " make sure either they make the contribution in EPf or not.And probably you will have to submit the copy of Muster attendance Record of the company they was working during the demise along with medical certificate of the doctor for proving although the member was not attending the duty but same was on role of the company.

Family Pension & EDLI benefits are available only if the PF Member is in continuous employment at the time of death. You have mentioned that your father was taking treatment between July, 2016 to Feb. 2017. What about March & April, 2017? Had his employer given him authorised leave and have you submitted medical reports and sickness certificate to the Company?. What was his nature of employment, whether contractual or regular? If it is contractual and the security agency's contract expired say in March 2017, he is not eligible for any benefit. Moreover, if the contractor has recorded in the monthly PF return that the member has already left services than also he will not get any benefit.
Pls check whether your father was covered under ESIC? if yes, that will help to prove that he was under medical treatment and thus was in continuous employment.
