If a worker is appointed on monthly basis salary (viz Designated as Tailor in Garment industry), according to Tamilnadu minimum wage per day 335 INR should be remunerated, whereas according to his appointment order he is appointed on monthly salary of 8710 INR (i.e 335 x 26), in case of months having 27 working days is it legal to pay only the salary of 8710 INR or should the additional 1 day wage (i.e 8710 + 335) be paid.

Thank you, but does the monthly salary impact the no of working days in a month, say for example for the Month of February the working days are less but still the whole salary is paid. Doesn't the same rule apply if the working days are more.

Monthly salary, Daily salary, weekly salary, hourly salary...etc. all are different from each other. As per your question you have mentioned that person is getting salary as monthly basis. So where again days come from? It totally depends upon the month. It will not consider how many days or hours or week that particular person served. It only consider the month.

I would like to request you to go through the G.O issued by the Government. If the rates of minimum wages fixed for a particular category is by day or month, the method of its conversion to day or month as the case be would certainly have been given in the "explanations" to the G.O. IF the minimum wages fixed is at daily rate, to arrive at the monthly rate you have to multiply the daily rate by 30; if it is at monthly rate, the daily rate has to be arrived at by dividing the monthly rate by 26.
Therefore, as per your input, the monthly wages shall be Rs.10,050-00 [ 335 X 30 ] irrespective of the actual days of a particular calendar month. In your case, the industry monthly wages being paid is less than the minimum wages fixed.
